The parties to this Agreement, Instructor Retreat Ticket Holder (“Attendee”) and Evidence Based Birth, Inc (“Host”), a Kentucky C-Corp, enter this Agreement as of the date that the Attendee purchases a ticket to the 2026 Evidence Based Birth® Instructor Retreat (“Retreat”).
Registration Process and Payment Methods
Retreat registrations will not be confirmed until all forms are completed and the correct payment is received and processed.
Attendee should obtain confirmation before committing to other travel arrangements. The Host will NOT be responsible for any travel or accommodation costs or reimbursements.
Host cannot be responsible for your spam filters blocking your confirmation email or other important email messages about the event. Please regularly check your email, including spam and junk mail folders, for information and updates on the Retreat.
Your retreat registration fee DOES NOT INCLUDE TRAVEL (Airfare, etc.) OR LODGING costs. Attendee is responsible for making their own transportation and lodging arrangements, as well as arranging and paying for extra expenses.
Your retreat registration fee DOES NOT INCLUDE ALL MEALS. Lunch will be provided for all retreat attendees on Tuesday, May 19, and Wednesday, May 20. Attendees are responsible for additional meals on the days before, during, and after the 2-day retreat.
If you would like to bring a family member with you as a travel companion (spouse, partner, child caregiver, etc.), the Host will NOT be responsible for any travel, lodging, or meals.
Attendee must attend all retreat educational sessions in person to be eligible to obtain contact hours for the retreat. Nursing contact hour certificates will be given once an evaluation survey and/or quiz has been completed. Attendees must download and/or print contact hour certificates and any handouts within one month of the retreat. There will be no extensions given. It is the Attendee’s responsibility to save their own contact hour certificates.
Cancellation Policy
There are no refunds and no ticket transfers for this event. EBB recommends Attendee’s obtain their own travel insurance if there are concerns about canceling or not attending the Retreat.
Attendee must be an active EBB Instructor with a current signed Instructor Agreement at the date/time of the Retreat. If the Attendee purchases a ticket as an active EBB Instructor, but is not an active EBB Instructor at the time of the retreat, their ticket will be cancelled without refund. In the event a ticket is cancelled for the reason of the Attendee no longer being an Active Instructor, or the Attendee does not attend the event for any reason, Host is not responsible for travel expenses incurred by Attendee.
In the event EBB cancels the Retreat as a result of force majeure, Attendee’s fees paid for tickets (only) may be refunded by EBB. For purposes of this section, “force majeure” shall mean: (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; or (i) government-declared state of emergency.
Event program
Lunch will be provided on Tuesday, May 19 and Wednesday, May 20. A draft schedule of the Retreat will be provided but is subject to change.
Participation and Behavior
Retreat attendees are expected to behave appropriately. Attendees are expected to show kindness and respect to others while at the Retreat. Use of abusive, racist, homophobic, or transphobic language, or threating behavior directed to any other attendee or EBB Team Member is not conducive to a learning environment and will result in immediate removal and banning from the Retreat without refund
Attendees are not permitted to audio-record or video-record the Retreat.
Infant-in-Arms
Infants-in-arms are more than welcome to attend Retreat sessions. Attendees are asked to step outside the Retreat meeting room to settle a fussy baby. If an Attendee is traveling with an infant/toddler who is crawling or walking, the Attendee should arrange for caregiving to take place outside of the Retreat room.
Responsibility Personal Property and Care
The Host accepts no responsibility for loss or damage to personal property.
By purchasing a ticket to this event, the Attendee declares that they will not hold the Host liable for loss or damage of personal property.
The Hosts accept no responsibility for the health, safety, and well-being of participants.
By purchasing a ticket to this event, you declare that you will not hold the Hosts or any of their contractors or employees liable for any incurred injury, illness, or death, including during transportation from the airport to the retreat venue.
Attendees accept full responsibility for their personal property, health and well-being.
It is the Attendee’s responsibility to be on time for all events. Events will begin at assigned times. If an attendee misses an event (meal, etc.), there will be no refund for the events missed.
Image Rights Release
As a participant in retreat, upon the terms herewith stated, I hereby give to the Host, their heirs, legal representatives and assigns, and those acting with his/her authority and permission:
The unrestricted right and permission to copyright and use, re-use, sales through any visual or audio media, publish, live streaming and broadcast video or pictures of me or in which I may be included intact or in part, composite or distorted in character or form, without restriction as to changes or transformations in conjunction with my own or a fictitious name, or reproduction hereof in color or otherwise, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose whatsoever.
I also permit the use of any printed material in connection therewith.
I hereby relinquish any right that I may have to examine or approve the completed product or products or the advertising copy or printed matter that may be used in conjunction therewith or the use to which it may be applied.
I hereby release, discharge and agree to save harmless the Hosts, their heirs, legal representatives or assigns, and all persons functioning under their permission or authority, or those for whom they are functioning, from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
I hereby affirm that I am over the age of majority and have the right to contract in my own name. I have read the above authorization, release and agreement, prior to its execution; I fully understand the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns.
Results
Attendees understand that there is no guarantee by the Host of financial reward or business success, because of, due to, before or after the event. No warranties or guarantees either oral or written were made to me.
Indemnification
The Attendee agrees to indemnify, defend and hold the Host, its owners, directors, managers, employees, affiliates and suppliers, harmless from any and all liability, loss, claim, cause of action, and expense (including reasonable attorney’s fees) related to this Agreement, including but not limited to, cancellation of the Retreat or cancellation of an Attendee’s ticket, your use of any content from the Retreat materials, including any claim or demand, made by any third party due to or arising directly or indirectly out of your conduct or in connection with your use of EBB Retreat materials.
